Philanthropy’s Second Generation: Challenges and Opportunities in Working with a Donor’s Descendants

Wednesday, March 8, 2023

Kyle T. Mordew, J.D.
Associate and Ohio/Florida Liaison, Hahn Loeser & Parks, LLP

A donor’s descendants can present unique challenges and planning opportunities. For example, testamentary CRUTs are an excellent vehicle for maximizing IRA benefits for the charitably inclined who also do not wish for their descendants to receive the donor’s entire IRA within 10 years. On the other hand, challenges can exist when communication is not clear among the donor, charitable organization, and donor’s descendants. If a gift agreement is unclear regarding whether an unsatisfied pledge is enforceable against the donor’s estate, this could cause issues between descendants and the charitable organization. Steps can be taken in the gift agreement or estate plan to mitigate these problems after a donor’s death.

Join us to learn more from Kyle Mordew, an estate planning attorney with Hahn Loeser’s Naples, Florida office. Kyle has vast experience advising his clients on charitable estate planning matters.
