Philanthropy’s Second Generation: Challenges and Opportunities in Working with a Donor’s Descendants

A donor’s descendants can present unique challenges and planning opportunities. For example, testamentary CRUTs are an excellent vehicle for maximizing IRA benefits for the charitably inclined who also do not wish for their descendants to receive the donor’s entire IRA within 10 years. On the other hand, challenges can exist when communication is not clear among the donor, charitable organization, and donor’s descendants. If a gift agreement is unclear regarding whether an unsatisfied pledge is enforceable against the donor’s estate, this could cause issues between descendants and the charitable organization. Steps can be taken in the gift agreement or estate plan to mitigate these problems after a donor’s death.

Kyle Mordew is currently an Associate in Hahn Loeser’s Naples office and serves as the firm’s Ohio and Florida liaison for the Trust and Estates Practice Group. He is a double Buckeye, receiving his undergraduate degree in Political Science from Ohio State in 2012 and his law degree from Ohio State in 2016. Kyle has extensive experience working in estate planning, estate administration, and asset protection planning for higher net worth clients. He has written articles regarding domestic asset protections trust and discussed their continued utility under Ohio law and their treatment by courts around the country. He is admitted to the Ohio and Florida bars.
